Terms of Use

Please read this Agreement (“Agreement”) carefully as it governs your use of the website www.digitull.co.uk (the "Site"). By continuing to use the Site you are agreeing to the terms that appear below. These terms take effect immediately on your first use of the Site and apply whenever you access the Site on whatever device.

If you are under 18, you should ask your teacher, parent or carer to check these terms. If you do not agree to be bound by these terms please do not access and/or use the Site. In respect of any subscription services or third party website to which you link through this site, specific terms and conditions for each site will prevail over this Agreement. .

1. Provision of Service

1.1 The Site is operated by The Children's University Hull (company number 6368105, registered charity number 1124329), whose registered office is at The Hull C U Ltd. The University of Hull, 65 Salmon Grove, Hull HU6 7SZ. If you are accessing the Site from your school's subscription arrangement to our product, the terms and conditions for the product will prevail over this Agreement.

1.2 The Digitull system operates through a variety of browsers, including Firefox, Chrome and Internet Explorer (minimum of IE9) and each school is responsible for ensuring there is adequate access to the internet and specified browser.

2. Limited Rights to Use Content

2.1 All material displayed on the Site ("Content") belongs to “Digitull” or its licensors. Subject to clause 2.2, you may retrieve and display the Content on a computer screen, print individual pages on paper and store such pages in electronic form on disk (but not on any server or other storage device connected to an external network) for your own personal, educational, non-commercial purposes. .

2.2 Content on the Site is owned by “Digitull” but any Content used under licence from third parties ("Third Party Content") will be marked with the copyright notice of those third parties. Some of the Third Party Content will be subject to additional restrictions - the relevant copyright notice will make it clear where that is the case. You must comply with such restrictions. .

2.3 You may not (without prior written permission from “Digitull”): .

  • redistribute any of the Content or supply it to other people (including by using it as part of any library, archive or similar service);
  • remove the copyright or trade mark notice from any copies of Content made under this Agreement;
  • create a database in electronic or structured manual form by systematically downloading and storing all or any of the Content;
  • except as expressly set out above, modify, reproduce or in any way commercially exploit any of the Content.

2.4 You acknowledge that the names, images and logos identifying “Digitull” and third parties and their products and services are subject to design rights and trademarks of “Digitull" and third parties and that you may not use them without written permission.

3. Participation

3.1 The Site may include links to Twitter, Facebook, Flickr, Linkedin, Blogger, news area, bulletin boards, discussion groups and other public areas that allow feedback to “Digitull” and interaction between users. The Site will permit personnel from subscribing organisations to the site in the appropriate place. The opinions, advice and statements contained in messages posted on the Site ("Messages") other than those offered on a drop down list are those of the Users and not “Digitull”. Where Users can post Messages there will be a statement concerning how all messages can be viewed through the teacher system and terms which help control the content. “Digitull” reserves the right to monitor all materials closely and delete, move and edit any material submitted. You are solely responsible for the material you submit to the Site and by submitting any material you agree that you will not submit any material that:

  • could be deemed offensive by any individual;
  • advertises or promotes any goods or services;
  • reveals any confidential or sensitive information;
  • contains or links to any unlawful, threatening, abusive, libellous, indecent or otherwise illegal material;
  • contains any material which you do not have permission to use (including material which may be protected by copyright, trade marks, database right or any other form of intellectual property right);
  • contains viruses or any other components with harmful or contaminating properties which may affect the Site or any equipment connected to it;
  • disguises your identity or impersonates any person.

“Digitull” stresses that although it will do what it can to minimise the risks related to e-safety associated with children’s interaction with the system, overall responsibility for the safe and acceptable use of the internet lies with each subscribing organisation and practice should follow the procedures stated within their own e-safety policies.

3.2 Where you are invited to submit any contribution to the Site (including any text, photographs, graphics, video or audio) you agree, by submitting your contribution, to grant “Digitull” a perpetual, royalty-free, non-exclusive, sub-licensable right to use, reproduce, modify and distribute your contribution worldwide in any media. If you do not want to grant “Digitull” the rights set out above, please do not submit your contribution to the Site. .

3.3 “Digitull”will endeavour to ensure that any material submitted will be appropriate but cannot guarantee the accuracy, integrity or quality of any material submitted by users over whom “Digitull” has no control. However all reasonable care will be taken to prevent Users from breaching these terms and posting material that is misleading, untrue or offensive - you must bear all risk associated with your viewing of such material. .

3.4 Copyright in any software that is made available for download for the participation in the Site ("Software") belongs to “Digitull” or its suppliers. Your use of the Software is governed by the terms of any licence agreement that may accompany or be included with the Software. Where certain areas on the Site may be subject to additional terms of use then these will be available to view and all subscribers must comply with such terms. .

4. Limited Warranties

4.1 “Digitull” will use its reasonable skill and care in making the Site available to you and in ensuring its continuing availability. However, because of the number of sources from which “Digitull” obtains the Content and because of the nature of the Internet and computer software and hardware, “Digitull” does not give you any other warranties. In particular, you should not take the accuracy or availability of the information for granted and “Digitull” makes no warranty that the Site is free from infection by viruses or anything else that has contaminating or destructive properties. All implied warranties are excluded from this Agreement to the extent that they must be excluded as a matter of law.

5. Limitation of Liability

5.1 In respect of the Content which is available on the Site, “Digitull” will endeavour to resolve faults as soon as is reasonably possible in line with each subscribing organisation’s contract with “Digitull”.

5.2 Except where we have expressly agreed otherwise, neither you nor “Digitull” will be responsible for any losses that the other suffers as a result of a breach of this Agreement except those losses which are a foreseeable consequence of the breach. Neither party will be responsible for indirect losses which happen as a side-effect of the main loss or damage and which are not foreseeable by “Digitull” and you (such as loss of profits or loss of data).

5.3 Notwithstanding the above provisions of this clause 5, “Digitull” liability will not be limited in the case of death or personal injury directly caused by “Digitull’s” negligence.

6. Privacy Policy

6.1 Any information that you provide about yourself to “Digitull” will only be used by “Digitull” in accordance with its Privacy Policy. Please read the Privacy Policy carefully and if you have any questions please email hello@digitull.co.uk

7. Changes

7.1 ”Digitull” is continually seeking to improve the Site and services offered. “Digitull” reserves the right, at its discretion, to make changes to any part of the Site.

7.2 “Digitull” may change or add to this Agreement as a result of its policy of updating and improving the Site or for security, legal or regulatory reasons. ”Digitull” will post any changes or additions to this Agreement online. If you do not agree to be bound by those changes, you should not access and/or use the Site any further. .

8. Links

8.1 The Site may contain links to other resources and, where possible, “Digitull” will make clear where such links are being made. Where independent third parties provide these sites “Digitull” is not responsible and shall not be liable for the availability or content of these outside resources. Where “Digitull” provides these sites, specific terms and conditions for each site will prevail over this Agreement. “Digitull” is not responsible for the contents of any site linking to “Digitull”.

9 Third party material

9.1 Contributions to areas of the Site which allow the submission of materials will be closely monitored and whilst we accept no responsibility for the content, including, without limitation, any error, omission or inaccuracy therein, “Digitull” will reserve the right to delete, move or edit any material submitted.

9.2 Any perceived advertising is unintentional. However, where references are made to specific locations, services or people and are contained within the video materials then all reasonable care has been taken to obtain signed consent.

10. Payment Terms

10.1 Free usage period will be inclusive of any number of pupils and teacher users. By accepting free usage all user organisations will be requested to forward payment details. Package options will be sent within 28 days before the end of the free usage period with no obligation to purchase. If the school decides not to take their Digitull account forward beyond the free usage period, access will be blocked for all users of this school.

10.2 No charges will be incurred by the school within the 2016/17 academic year (September 1st 2016 to July 31st 2017)

10.3 An organisation will be registered to use Digitull as soon as an organisation’s Lead /Head confirms interest via the system, email, fax or post and we have verified user authenticity. A user will be deemed to be authentic when they can demonstrate their link to a school or similar organisation.

10.4 From August 1st 2017 Schools will be required to pay £25 per month which can be paid either by direct debit or in full.

10.5 A Direct Debit system can be set up to take payments.

10.6 No refund is given if an organisation does not use the full number of pupil logins offered by their payment package.

10.7 Subscription is based on a 12 month period.

11. General

11.1 You may not transfer any of your rights under these Terms and Conditions to any other person.

11.2 If you breach this Agreement and “Digitull” chooses to ignore this, “Digitull” will still be entitled to use its rights and remedies at a later date or in any other situation where you breach this Agreement.

11.3 A person who is not party to this Agreement shall have no right to enforce any of its terms.

“Digitull” will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so under English law within the United Kingdom

11.4 Headings in this Agreement are for convenience only and will have no legal meaning or effect.

Privacy Policy

1) Information Collected

(a) It may be necessary for Digitull to collect your personal information for the purposes of registering you as a user for the website www.digitull.co.uk (the "Site"). Your responses help us to provide as complete a service as possible for you by ensuring that the Site reflects your needs and requirements.

(b) “Digitull” uses Google Analytics to collect data listing which of “Digitull's” pages are most frequently visited and by which type of users.

2) Data Protection and Disclosure

(a) Where “Digitull” maintains registrations it takes all reasonable endeavours to comply with all requirements of the UK Data Protection Act 1998 and any regulation created under it.

(b) “Digitull” will not disclose any of your personally identifiable information except with your permission or under special circumstances such as when it believes in good faith that the law requires disclosure or when we engage third parties to process data on our behalf.

3) Further Use of Information

(a) “Digitull” does not sell, trade or rent user information to others.

(b) “Digitull” will not pass on your personal information unless you have given your prior consent. Otherwise, “Digitull” will only share aggregate statistics about sales and traffic pattern, but these statistics will not include any personally identifiable information.

4) Cookies

In addition to the information which you supply when you are asked to register with us, information and data may be automatically collected through the use of cookies. 'Cookies' are small pieces of information that are stored by your browser on your computer's hard drive. When you visit a website, that website is able to generate a small text-file which your browser then stores on your computer's hard drive. The next time you visit the same site, it will look for the text file on your machine and, if it finds it, will know that you've previously visited the site. The site may then act accordingly; it might welcome you personally, for instance. You can think of cookies as providing a "memory" for the website, enabling it to recognise a user and respond appropriately.

5) “Digitull” Security Policy

(a) No data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, “Digitull” cannot ensure or warrant the security of any information you transmit to “Digitull” and you do so at your own risk.

(b) Following transmission, “Digitull” will make best efforts to ensure the security of the information on its systems.

(c) We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect on line. We use encryption when collecting or transferring sensitive data such as credit card information.

At “Digitull” we collect information about our users to help us continually improve the service we offer.

Our principles

We are absolutely committed to protecting your privacy. Our policy can be summarised in one sentence: we will not share your information with others without your prior consent. We have also established the following three principles:

1) We will respect your email privacy, and will send you unsolicited mail from “Digitull” only if you have agreed to this

2) We will not pass on any individual user details (including your email address)

3) We will only use aggregate statistics about our users, sales and traffic patterns to help improve the service we offer

What information do we collect?

We collect only basic information. This includes your name, school email address, school postal address and date of birth. We may also ask some further, voluntary questions so subscribers can use the information for the benefit of themselves. We can also gain a clearer understanding of our users to help us improve the services we offer.

We collect data listing which of our pages are most frequently visited and by which types of users. When you enter a contest or other promotional feature, we may ask for personal details and email.
